Therefore, for the purposes of REGULATION (EU) 2016/679 OF THE EUROPEAN PARLIAMENT AND OF THE COUNCIL of 27 April 2016 (hereinafter, “GDPR”) concerning the protection of natural persons regarding the processing of personal data and the free movement of such data, ORGANIC LAW 3/2018, of December 5, on the Protection of Personal Data and Guarantee of Digital Rights (LOPD GDD), and LAW 34/2002, of July 11, on Information Society Services and Electronic Commerce (hereinafter, “LSSI”), F-HOLDING informs the user that, as the data controller, it will incorporate the personal data provided by users into an automated file.

What data do we collect?

The personal data that the user may provide:

  • First and last name, Tax ID, and address.
  • Phone number and email address.
  • Payment information.
  • IP address, date and time you accessed our services, the web browser you use, and data about your device’s operating system.

If you do not provide us with your data, or do so incorrectly or incompletely, we will not be able to process your request, making it impossible to provide you with the requested information or carry out the contracting of services.

Why and for what purpose do we process your data?

At F-HOLDING, we process the information provided by interested parties for the following purposes:

  • Manage and contract some of our services.
  • Manage the sending of the information requested from us.
  • Maintain and manage the relationship with the user, as well as manage the services offered through the website and information tasks.
  • In some cases, it will be necessary to provide information to Authorities or third-party companies for audit purposes, as well as handle personal data from invoices, contracts, and documents to respond to claims from customers or Public Administrations.

We inform you that the personal data obtained as a result of your registration as a user will form part of the Registry of Activities and Processing Operations (RAT), which will be updated periodically in accordance with the provisions of the GDPR.

Who is responsible for the accuracy and veracity of the provided data?

The user is solely responsible for the accuracy and correctness of the data submitted, exonerating F-HOLDING from any liability in this regard. Users guarantee and are responsible, in any case, for the accuracy, validity, and authenticity of the personal data provided, and they commit to keeping it properly updated. The user agrees to provide complete and accurate information in the registration or subscription form. F-HOLDING reserves the right to terminate the contracted services if the provided data is false, incomplete, inaccurate, or outdated.

F-HOLDING is not responsible for the accuracy of information not produced by F-HOLDING and for which another source is indicated, nor does it assume any responsibility for potential damages that may arise from the use of such information.

F-HOLDING reserves the right to update, modify, or delete the information contained on its web pages, and may even limit or deny access to this information. F-HOLDING is exempt from liability for any damage or harm the user may suffer as a result of errors, defects, or omissions in the information provided by F-HOLDING when it comes from external sources.

Additionally, the user certifies that they are over 14 years old and possess the necessary legal capacity to provide consent regarding the processing of their personal data.

How do we handle the personal data of minors?

In principle, our services are not specifically aimed at minors. However, in the case that any of them are directed to individuals under the age of 14, in accordance with Article 8 of the GDPR and Article 7 of LO 3/2018, of December 5 (LOPDGDD), F-HOLDING will require the valid, free, unequivocal, specific, and informed consent of their legal guardians to process the personal data of minors. In this case, the ID card or another form of identification of the person providing the consent will be required.

In the case of individuals over the age of 14, the data may be processed with the user’s consent, except in cases where the law requires the assistance of legal guardians.

What security measures do we apply to protect your personal data?

F-HOLDING has adopted the legally required levels of security for the protection of personal data and strives to install other additional technical means and measures within its reach to prevent the loss, misuse, alteration, unauthorized access, and theft of the personal data provided to F-HOLDING.

F-HOLDING is not responsible for hypothetical damages that may result from interferences, omissions, interruptions, computer viruses, telephone malfunctions, or disconnections in the operational functioning of this electronic system, caused by reasons beyond F-HOLDING’s control; for delays or blockages in the use of this electronic system caused by deficiencies or overloading of telephone lines or overloading of the Data Processing Center, the Internet system, or other electronic systems, as well as for damages that may be caused by third parties through illegal intrusions beyond F-HOLDING’s control. Nevertheless, the user should be aware that Internet security measures are not infallible.
